Under general direction of the President, represents the System in all legal affairs, provides counsel and recommendations on legal aspects of the System’s objectives, policies and plans and assures that the System’s rights and interests are adequately protected and that the legal obligations and duties of the System are properly recognized and executed.
Examples of Typical Tasks:
Directs the Office of Legal Affairs (The Office of the General Counsel, The Office of Claims and Litigation, and The Office of Equal Employment Opportunity) for the System, inclusive of matters affecting the Board of Directors, employees and the System, and the powers, rights, duties and obligations of each.
Establishes and maintains quality standards on drafting and legal review of NYC Health + Hospitals contracts to ensure uniformity.
Communicates, to employees of the System, policy and directions on legal aspects of operating matters and oversees litigation.
Conducts litigations including the prosecution and defense of all legal actions brought by or against the System.
Monitors the participation of the System in all quasi-judicial proceedings in which the System may be involved, including administrative, arbitration, legislative and other similar proceedings calling for the attendance of witnesses or the presentation of written or documentary testimony or evidence.
Serves as the System’s legal representative to City, State and Federal agencies.
Administers legal activities in all areas affecting the System such as acquisition or disposal of interest in real property, patents, trademarks, copyrights, new processes and services, pricing and costing, collective bargaining and labor relations, labor legislation, and Federal, State and local taxes.
Prepares or approves system legal documents, statements, certifications, etc., required or prepared for Federal, State or other governmental bodies or agencies, thereof.
Advises and makes recommendations on legal aspects of system procedures, business relationships, communications and related matters, anticipating and guarding against legal risk.
Advises and makes recommendations to system management on questions of law, statutes, administrative codes, regulations and ruling affecting the operation of the System.
Supervises the activities of the attorney and support staff; directs, evaluates work performance and makes recommendations to take appropriate action within guidelines of system personnel policies.
Supervises the engagement of outside legal counsel by the System or any unit thereof and reviews and authorizes payment of fees.
Works collaboratively with operating entities and other central office functions as the customer to support effective service delivery.
Works effectively and efficiently with the NYC Law Department and outside counsel on matters that they serve as counsel on behalf of the System.
Provides prompt and clear advice and counsel that reflects consultation and coordination with other central office functions.
Provides ongoing and timely escalation of key issues, and monitors resolutions.
Performs related duties, as required.
A Baccalaureate Degree from an accredited college or university and ten years of progressively responsible experience in health and medical service administration, public administration, personnel and labor relations, finance or appropriate functional discipline with an emphasis on planning, liaison and interorganizational relationships, or related administrative or managerial functions; or,
A Master's Degree in Hospital Administration, Health Care Planning, Business Administration, Public Administration or an approved related program and nine years of progressively responsible experience in health and medical service administration, public administration, personnel and labor relations or related administrative or managerial functions; or,
A satisfactory equivalent combination of education, training and experience.
Admission to the New York State Bar; and
Ten (10) years of highly responsible experience and background in the practice of law in a health care setting subsequent to admission to the Bar, or
A satisfactory equivalent of experience and training, however, all candidates must be admitted to the New York State Bar.
