Rutgers, The State University of New Jersey, is seeking a Senior Assistant General Counsel – Healthcare for The Rutgers General Counsel Office. This position reports to the Senior Vice President and General Counsel as well as the Associate Vice President and Deputy General Counsel. The Senior Assistant General Counsel – Healthcare is primarily assigned to advise Rutgers University's health sciences schools, institutes and centers. The position provides legal representation for Rutgers University in various areas including, negotiating and advising on contracts, clinical services agreements, academic affiliation agreements professional services agreements and other transactional matters. The position will be based in New Brunswick with approximately one day a week in Newark.
Among the key duties of this position are the following:
Assists with health law/risk management issues.
Advises on regulatory compliance matters including Stark/Anti-Kickback and patient privacy.
Participates in training and preventative law presentations for Rutgers University faculty, staff, administration and governance boards.
Provides advice, education, and counsel regarding litigation, subpoenas, and general higher education legal issues.
Minimum Education and Experience:
JD from an accredited law school
A minimum of five years of significant relevant experience providing legal services in a healthcare setting or to healthcare clients.
Required Knowledge, Skills, and Abilities:
Experience advising healthcare providers on legal and risk matters related to their clinical practice
Effective leadership skills with the ability to participate in innovation and change, strategic thinking, and problem solving
Demonstrated ability to work in a collegial and professional manner with peers and clients
Effective communication skills in both written and verbal presentation, including all aspects of legal writing
Ability to function effectively in a fast-paced and changing environment with multiple priorities and objectives
Extensive knowledge of the legal and regulatory issues governing the provision of healthcare
Knowledge of current statutes, regulations, and case law applicable to governmental entities including NJ Conflicts of Interest, Open Public Records Act, etc., that impact planning and procedures related to internal and external relationships
Experience with healthcare industry provider agreements and clinical and academic affiliation agreements
Knowledge of Stark and Anti-Kickback laws and regulations
Knowledge of HIPAA and other federal and New Jersey laws governing the privacy of medical information
Knowledge of the Affordable Care Act and regulations
Knowledge of public records and open meetings laws and their impact on the administration of the academic healthcare enterprise
Knowledge of negotiating principles and techniques used to effectively and successfully advocate for the goals and objectives of the academic health center
Member, in good standing, of the New Jersey State Bar preferred (or become admitted within one year of hire);
Rutgers is seeking an attorney with at least 5 years of health care experience touching on a wide range of topics including affiliations, service agreements, regulatory compliance, payor agreements, and policy and procedure development.
Someone with in-house experience or experience advising academic medical centers will be preferred.
Experience in the law related to public entities is also a plus.
