The Center for Student Conduct is responsible for administering and upholding UC Berkeley's Code of Student Conduct and policies established by the Regents of the University of California. The workings of the Center for Student Conduct may irrevocably alter the lives of our students and has the potential to lead to high profile lawsuits, audits, and investigations. The Center for Student Conduct administers the student conduct process on campus in a manner that encourages student development and provides conflict resolution that is respectful of all parties through the consistent and objective application of campus and University policy. This position, which will serve as student conduct coordinator for the most complex and serious cases of student academic and behavioral misconduct, including, but not limited to sexual violence and sexual harassment (SVSH) cases involving student respondents, has the authority and responsibility to make precedent-setting decisions regarding policies and procedures that directly impact the University. The work performed by the Senior Student Conduct Coordinator involves managing risk for the campus, and is extremely complex, confidential, and layered. It requires a comprehensive knowledge of the following: student conduct administration; investigation techniques, trauma-informed practices pertaining to investigating, adjudicating, and interacting with people involved in sexual assault and interpersonal violence cases; the Office for the Prevention of Harassment and Discrimination (OPHD) and all of their pertinent guiding policies and documents; Title IX; the Violence Against Women Act; the Clery Act; FERPA, the Office of Civil Rights and their Dear Colleague Letters pertaining to SVSH; Federal, state, and local laws and regulations; emerging legislation in this area; and student affairs in general. The incumbent will serve on campus wide committees pertaining to student behavior, student organizations, and SVSH. They must have a strong leadership presence on campus and within the community, and must feel equally comfortable interacting with the most senior campus administrators, UCOP leadership, defense attorneys, campus colleagues and peers, survivors of SVSH, and students responding to charges. Responsibilities SVSH CONDUCT CASE ADJUDICATION AND MANAGEMENT: Serves as subject matter expert on UCOP's student adjudication model for SVSH cases and CSC adjudicator for such cases. Executes all duties related to SVSH case management and record keeping with precision and sensitivity under pressure and scrutiny from multiple sources (including the Federal and state government, the media, outside agencies, and the campus community), within strict time constraints and in compliance within UC policies and applicable laws and regulations. - Determine appropriate charges and alleged policy violations for all SVSH cases proceeding through the student adjudication model.
- Using expert level understanding of trauma-informed practices, meets with respondents, complainants, and each party's advisors as they respond to investigative findings as part of the adjudication process.
- Reviews allegations and coordinates with campus partners to develop and implement interim measures, including Interim Suspensions.
- Makes final determination regarding policy violations of the campus Sexual Violence and Sexual Harassment policy and Student Code of Conduct. Issues finding, rationale, and sanctions (when appropriate) using superior written communication skills.
- Interprets, implements, and applies the SVSH sanctioning rubric.
- Responds in writing to all appeals of the SVSH policy.
- Participates as a witness in SVSH appeal hearings.
- Issues, implements, monitors, and when necessary, modifies interim measures, including No Contact Directives, associated with SVSH cases on behalf of CSC and OPHD.
- Assists with data collection for University, systemwide, and media requests regarding SVSH cases.
CAMPUS WIDE COMMITTEES AND WORKGROUPS: Serves as CSC representative on campus wide committees and workgroups. - Serves on the SVSH Case Management Team, a multidisciplinary team and that is charged by the Office of the President to track and manage all campus cases of SVSH. In this capacity, develops and implements action plans for the handling of student misconduct related to SVSH. Serves as subject matter expert on SVSH case adjudication. Recommends and implements interim protective measures.
- Serves as backup for the Associate Director to the Students of Concern Committee. In this capacity, serves as CSC subject matter expert by devising and implementing action plans for interacting with and handling cases in which students are exhibiting distressing, disturbing and/or disruptive behavior. Recommends interim suspensions when necessary.
OTHER CASE ADJUDICATION: - As the Senior Student Conduct Coordinator, adjudicate the highest level cases referred to CSC in which students are facing suspension or dismissal from the university.
- Draft interim suspension letters on behalf of the Director and represent the University in all Interim Suspension hearings.
- Investigate and adjudicate both academic and behavioral misconduct by students and/or student groups.
-Determine whether sufficient evidence exists to proceed with charges against students/student groups. Identify and charge appropriate violation(s) of campus regulations and interview student(s), witnesses, and/or representative(s). Negotiate administrative resolutions. -Represent the University at hearings. -Implement and track sanctions. -Provide written responses to appeals. - Communicate on sensitive and confidential matters regarding complex cases, hearings, and appeals with senior administrators including the VCSA and AVC/DOS, and other deans, directors, faculty, campus counsel, UCPD, and campus/community partners.
OTHER DUTIES AS ASSIGNED BY THE DIRECTOR OR ASSOCIATE DIRECTOR: - Policy development and review
- Remaining up to date and abreast of trends and legislative changes that impact student conduct administration in general, and SVSH case management in particular
Required Qualifications - Advanced level knowledge of and experience in student conduct administration.
- Expert level knowledge of SVSH case handling, including trauma-informed practices pertaining to investigation and adjudication of these cases.
- Advanced knowledge of Title IX and Title IX investigation techniques.
- Advanced knowledge of VAWA, the Clery Act, the Office of Civil Rights and their Dear Colleague Letters pertaining to SVSH, FERPA, and Federal and state laws and regulations that govern student conduct administration.
- Superior written and oral communication skills
- Ability to juggle and meet multiple, competing priorities and deadlines in a high stress environment
- Strong political acumen and a proven track record of strong cross campus relationships and collaborations with colleagues at all levels of the institution.
- Advanced skills in judgment and decision-making, problem solving, identifying measures of system performance and the actions to improve performance.
- Ability in project management, problem identification, reasoning.
- Ability to develop original ideas to solve problems.
- Advanced knowledge of advising and counseling techniques.
- Knowledge of common University-specific computer application programs
- Knowledge of University and departmental principles and procedures involved in risk assessment and evaluating risks as to likelihood and consequences.
- Masters degree in Student Affairs/Higher Education counseling/administration, Juris Doctor, or related area and at least two years of student conduct experience.
- Recent (within the past year) training on trauma-informed interviewing, investigation, and adjudication techniques.
- Recent (within the past year) experience adjudicating cases of student or workplace sexual violence and sexual harassment.
- Title IX Investigator Certification or ability and commitment to obtain certification within one year of hire.
