Kelly Services, a Global Workforce Solutions company, is seeking a Director, Legal Counsel 1 located at the Troy, MI HQ. Counsel must have a proven background in employment law and employment-related claims and litigation, including demonstrated experience in the following areas and functions:
Major Duties & Responsibilities:
Counseling of leadership and human resources management on all aspects of daily employment-related issues, including (but not limited to): hiring and termination, reductions in force, restructuring, ADA issues/processes, accommodations, discrimination, harassment, retaliation, FLSA, wage and hour, testing, drug screening, background screening, FCRA, privacy, safety, labor relations, ULP, NLRB, non-disclosure/non-competition agreements, employment agreements, compensation, and employee benefits.
Supporting, developing, and implementing employment-related policies and procedures, databases, training, and compliance programs and procedures.
Researching, keeping abreast of, and regularly reporting on employment-related best practices, and state and federal regulatory and legislative developments.
Investigating and responding to employment-related charges, notices, and complaints raised by various administrative agencies, including (but not limited to): EEOC, OSHA, DOL, and state or local human rights departments.
Handling, managing, and reporting on employment-related litigation, arbitrations, mediations, audits, and investigations to achieve cost-effective and desired results, directly and through the use of outside counsel.
Drafting, reviewing and negotiating employment agreements and contracts.
Drafting and revising employee handbooks, policies, and forms.
Law degree from a nationally recognized law school and current admission to a state bar.
A minimum of 5-12 years of legal experience as a labor and employment attorney, including experience advising clients on a wide array of employment law issues.
A minimum of 5 years of in-house legal experience at a global public company, leading an employment law group, or being the sole employment lawyer.
A deep understanding of non-compete laws and confidentiality protections in the US and globally and experience enforcing employment agreements.
Knowledge of employee compensation and benefits, including ERISA.
Experience representing companies in threatened or active legal proceedings.
Experience investigating and helping to resolve employee relations issues and complaints.
Experience drafting employee handbooks, policies, forms and agreements.
Experience training employees on a variety of employment law topics.
Effective interpersonal skills and a strong ability to communicate in both verbal and written form with employees throughout the company.
Excellent organizational and planning skills and the capacity to simultaneously handle a variety of complex, sensitive and confidential issues.
