The Conflicts Counsel team supports the firm’s critical risk management functions by performing all duties associated with preventing, mitigating, and resolving actual and potential conflicts of interest, including: reviewing new business intake forms using proprietary software in order to ensure that all relevant parties have been listed and categorized correctly regarding their role in the matter; researching external and internal databases for pertinent information on prospective clients and other parties to a matter; analyzing conflicts reports for the purposes of identifying and resolving ethical and business conflicts of interest; and working closely with the firm’s full roster of attorneys and administrative staff in order to work toward a resolution of identified conflicts of interest. The ability to research and interpret the law in multiple jurisdictions to determine whether there is a conflict of interest, and whether it can be resolved, is critical, as are the abilities to prioritize tasks, manage a busy workflow, be detail oriented, and work well both independently and as part of a team. Candidates should have a basic familiarity with a wide range of practice areas, and should be able to communicate effectively with team members, the attorney(s) bringing in new business, and the firm’s leadership alike. Conflicts Counsel also vet incoming laterals to ensure that there are no irresolvable conflicts of interest between the lateral’s book of business and the firm’s. Additionally, they are occasionally asked to assist with erecting ethical screens, drafting engagement and waiver letters, conducting research on questions of law, and other special projects as requested. Education, training, experience:
Experience in a legal or conflict environment required.
Knowledge of conflict of interest principles preferred, including the ability to utilize research tools such as: Dun & Bradstreet, Lexis, Hoover's, and Edgar, LegalKey and be able to interpret the data produced by those systems.
Apply the laws of professional responsibility in identifying and resolving actual and potential conflicts of interest.
Identify parties involved in various types of legal transactions (including corporate, litigation, bankruptcy, labor & employment, tax, and estate planning matters) and define litigation, bankruptcy, labor & employment, tax, and estate planning matters) and define relationships within the conflict of interest system relationships.
Determine when it is appropriate and/or necessary to escalate an issue to the Risk Avoidance Manager or General Counsel.
