Position description The Berkeley Center For Law & Technology is seeking to hire a Biometric Regulatory Fellow.
BCLT was founded in 1995 to develop an unparalleled program for training future lawyers for careers at the intersection of law and technology and to serve as a forum where faculty members from the university, leading lawyers and entrepreneurs from Silicon Valley, and national policymakers could exchange ideas about the increasingly important range of legal and policy issues affecting technology companies and the broader society. As BCLT has grown, it has broadened its mission beyond its initial focus on intellectual property to encompass privacy, cybersecurity, biotech, antitrust, electronic commerce, entertainment law, telecommunications regulation, cybercrime, and many other areas of constitutional and business law that are affected by new information technologies.
BCLT has developed the most comprehensive and innovative program in law and technology in the world. Its mission is to foster the beneficial and ethical advancement of technology by promoting the understanding and guiding the development of intellectual property and related fields of law and policy as they intersect with business, science and technology.
Privacy Regulation
Some of the most complex data and technology issues occurring today involve the regulation of biometric data. Regulation of biometric data and related technologies is, at best, a patchwork system. Nations, groups of nations, regional governments, and even cities are all competing to determine how biometric data will be protected and how it will be used. These competing jurisdictions are often focused on very different and, sometimes, incompatible outcomes.
Global issues-including human rights, government surveillance, international economic competition, drug development, and high technology development-are all implicated by the future of biometric data regulation. The future may depend upon countries coalescing around one general model for biometric data and technology regulation. We have already seen that global regulation of privacy data was heavily impacted by the early model adopted and championed by Europe. The GDPR framework and approach became the starting point for other nations and jurisdictions looking to develop their own privacy policies. Early proposals from major economic players like China could similarly become the de facto standard for the regulation of biometric data and technologies.
The regulatory state of the three major players in the biometric arena cannot be ignored. China, the E.U., and the U.S. have different approaches and different, possibly incompatible, end goals. A thorough comparative study of these evolving regulatory schemes is required.
Project
The goal of the BCLT Biometric Regulatory Project is to serve students and faculty at the UC Berkeley School of Law and across the UCB campus as well as the broader community of innovators, attorneys, judges, and policymakers confronting legal issues affecting biometric data regulation worldwide. The Project will encompass a wide range of developments in biometric data and interrelated areas of regulation and privacy law.
Job Responsibilities
Engaging in a variety of activities to support the on-going project research and implementation
Conducting research on biometric regulation issues and solutions, under the direction of and in collaboration with BCLT team members, affiliates, and other experts in relevant fields
Developing projects and initiatives in collaboration with BCLT team members
Drafting outputs in a variety of possible formats, ranging from academic papers, treatises, legal summaries, and conference reports
Working with leads in organizing and facilitating meetings, workshops, and other convenings with subject matter experts
Presenting findings, updates, interim reports, etc. to sponsors, media, and nongovernmental, governmental, academic, and/or stakeholder communities as needed
Assisting with other miscellaneous aspects of project activities as appropriate
Candidates must hold an advanced degree at time of application, such as a J.D., M.B.A., Ph.D. or equivalent international degree. Preferred qualifications
3 years of experience in a related field, including but not limited to the practice of law
Excellent research, analytical, and writing skills
Experience and knowledge at the intersection of economics, science, business, and policy and the ability to work with people from a variety of disciplinary backgrounds and policy perspectives
Excellent communication and interpersonal skills, including the ability to communicate clearly, listen actively, interact with a variety of audiences, and share knowledge and information effectively
Excellent organizational skills
Self-starter able to prioritize and function both independently and collaboratively
Demonstrated ability to finish projects and deliver on commitments
Willingness to plunge into unfamiliar disciplines
