The Corporate Counsel, Privacy, is a member of the T-Mobile Privacy Office within the T-Mobile Legal Department. The Corporate Counsel, Privacy, provides practical and actionable legal and regulatory advice to Legal colleagues and client business teams, with an emphasis on transactions and data security compliance.
The Corporate Counsel both provides legal advice and practical guidance designed to advance and protect T-Mobile's brand as a consumer-focused "un-carrier." This position reports to the Director, Legal Affairs, Privacy & Data Security, under the direction of the Chief Privacy Officer.
Evaluates privacy & data security terms in supplier and customer contracts for alignment with T-Mobile policies and legal obligations, identifies optimal approaches to risk allocation, clarifies roles and responsibilities of the parties, and finds win-win solutions to close deals and win business, as well as to minimize legal risks;
Researches, develops, and provides legal advice on privacy and data security laws and regulations, internal policies, and industry best practices, including new and emerging legal developments impacting data privacy & security;
Evaluates proposed technology changes, operational changes, new products and services, and privacy compliance plans with an eye towards legal compliance as well as towards impacts to consumer welfare and company values;
Coordinates with other Legal colleagues and with other internal teams, including T-Mobile Risk Management and the T-Mobile Cybersecurity Trust & Protection Office, to arrive at optimal negotiating positions;
Apply legal and analytical skills to improve policies and procedures, monitor, measure, and retain records of transactional commitments, and support compliance with legal and regulatory requirements, in particular the FCC's CPNI regulations, the NY Department of Financial Services cybersecurity rules, and similar state law privacy and data security obligations;
Provide general support to the Care, Retail, and Digital teams on privacy and data security issues related to their work;
Train legal colleagues to help them advise their clients on data privacy and security issues, as well as develop and maintain guidelines, playbooks, templated terms, and other resources;
Understand and advise on the privacy requirements applicable to complex personal data flows across the data lifecycle;
Drafts internal and public-facing data security policies and other documentation; and
Assists with other projects and duties as assigned.
At least 3-5 years' experience as a licensed attorney, with a focus on privacy, cybersecurity, risk management and/or technology sales and transactions;
JD from a reputable law school;
Current state bar membership, in good standing (with the ability to become a licensed member of the Washington State bar within 6 months if necessary);
Working knowledge of major data security laws and regulations (e.g., GDPR, CCPA, CPNI, FTC Act, HIPAA, GLBA, VCDPA, etc.) and data security standards (NIST, PCI, etc.);
Practical experience with the development and implementation of privacy compliance programs, policies, and standards, including implementation of legal requirements arising from privacy legislation;
Demonstrated ability to perform and document detailed legal research and synthesize advice into concise summaries;
Demonstrated ability to provide practical and actionable advice in a dynamic and ambiguous legal environment;
Demonstrated ability to work independently, multi-task, and manage multiple assignments simultaneously;
Excellent verbal and written language skills; and
Excellent personal computer skills.
Contract negotiation experience (e.g., negotiating privacy and security provisions in master service agreements, supplier agreements, statements of work, etc.)
Technical fluency in Internet and telecommunications technology and cybersecurity;
Demonstrated ability to ; and
IAPP CIPP, CIPP/M or other privacy/data security certifications.
