POSITION DETAILS
The Office of the General Counsel (OGC) at The City University of New York (CUNY) is the system-wide resource for legal advice and representation. The OGC assists CUNY???s decision makers in advancing the University???s educational mission by providing expert, relevant and timely legal advice, guidance, and advocacy. The OGC provides legal assistance and advice to the Board of Trustees, the University???s central administration and its 25 constituent colleges, and its services touch all operational areas of the University and its campuses. The Office seeks an experienced compliance professional and/or licensed attorney, who excels in stewarding the broad and responsive execution of institution wide compliance programs that align with business operations, for the Chief Compliance Officer position. The Chief Compliance Officer will strategically direct and oversee comprehensive university-wide assessments of targeted compliance risk issues, investigations, or potential problems, and evaluate compliance with federal and state regulatory provisions, including, without limitation, those promulgated under HIPAA, FERPA, Title IV, Title IX, and Title VII, and to ensure the University???s compliance with federal and state laws, regulations, and priorities. Reporting to the Senior Vice Chancellor for Legal Affairs and General Counsel, and working in close partnership with the Assistant Vice Chancellor/Deputy General Counsel, the Chief Compliance Officer upholds regulatory and ethical compliance standards; reviews internal policies and monitors activities; and investigates and acts on compliance related matters to ensure that appropriate information is gathered and analyzed, risks are identified and assessed, and obligations are addressed and managed efficiently and effectively. Where there are allegations of any misconduct, including serious or systemic misconduct, the Chief Compliance Officer will coordinate the University???s internal investigation and support external investigators as required.
In addition to the job summary above, other essential duties include, but will not be limited to the following:
Provides expert legal guidance, collaboration and support to the evaluations of compliance and privacy initiatives and on-going activities for specific compliance areas, as well as the implementation processes for key compliance strategies, initiatives and action plans.
Directs university-wide HIPAA, FERPA, Title VII, Title IV and Title IX regulatory compliance activities and documentation, and develops guidance and official policies for all HIPAA Privacy, Security, and Breach Notification practices.
Leads the formulation of short and long-term strategic compliance planning, assessments, monitoring, and reporting consistent with regulatory, contractual, and ethical requirements, university policies, and industry practices.
Conducts operational risk assessments and compliance reviews in collaboration with other compliance and risk management units and functional areas, and constituent divisions, departments, and campuses.
Creates regular and periodic compliance reports/analyses to document the university???s compliance efforts with applicable laws and regulations.
Recommends improvements to assist administrators in ensuring compliance and refining internal controls which are capable of preventing and detecting significant instances or patterns of illegal, unethical, or improper activities.
Partners with senior administrators, faculty, staff and external regulatory agencies or government officials in the representation and development of various strategic compliance programs, policies, services and initiatives.
Directs and collaborates in the development of multi-faceted compliance and HIPAA educational awareness and training programs so that faculty, staff, and administrators are knowledgeable of institutional policies and pertinent federal and state standards and safeguards.
May supervise attorneys and other staff engaged in compliance programs and activities.
QUALIFICATIONS
A Juris Doctorate Degree from an ABA-accredited law school and at least ten (10) years' experience with compliance programs, particularly auditing, investigations, or law enforcement, in an academic setting or in a law firm representing higher education institutions in compliance matters is required . Plus, current New York State Bar membership in good standing, or admission in another jurisdiction with eligibility for admission to the NYS bar through reciprocity or passing of the NYS bar exam within one year of hire date.

Extensive knowledge of risk compliance, privacy, and auditing requirements, plus related systems and controls in the public and higher education sectors required.
Knowledge of employment and educational regulatory requirements, guidelines, and procedures for the administration of federal and state laws on civil rights, privacy, data security, and other areas (i.e. HIPAA, FERPA, ADA, 503/504, Title II, Title VI, Title VII and Title IX, Clery Act).
Advanced knowledge and skill in conducting investigations, negotiations, mediations and complaint resolution processes of high level/sensitive claims on behalf of the university.
Ability to interpret and advise on the application of various laws and regulations.
Effective communication and interpersonal skills with collaborative style to work effectively with diverse members of the university community and external constituents of various levels.
Detail-oriented and accurate with strong analytical, evaluative, and objective critical thinking skills, and ability to effectively summarize and present information.
Strong organizational and follow-through skills to prioritize work, manage multiple assignments, and meet deadlines.
Computer proficiency using administrative, and financial systems, databases, and programs, plus Microsoft Office programs, and remote/virtual meeting/conferencing and collaboration tools (MS Teams, Zoom, WebEx, Skype, etc.).
NOTES:
Until further notice, this is a hybrid position, eligible to work remotely and on-site in the office.
Candidates will be required to provide proof of being fully vaccinated against COVID-19 upon commencing employment. COMPENSATION AND BENEFITS
This position is in the University's Executive Compensation Plan. The salary range is $150,000 - $170,000; commensurate with qualifications, experience, and education.
