The Supervising Staff Attorney supports the Department’s and division’s mission to protect and improve the health of people in the State of Washington by providing thorough and professional legal services in support of the licensing and discipline of health care professionals and facilities. This position reports to the Office of Investigative and Legal Services (OILS) Director and supervises a team of Health Systems Quality Assurance (HSQA) staff attorneys (Hearings Examiner 3).
Responsibilities include, but are not limited to:
- Provide professional and technical expertise, deliver enhanced legal services, and provide department leadership in the areas of complex and emergency adjudication.
- As a leader in OILS (and a member of the OILS Management Team – OMT),
assist in the quality assurance of the overall HSQA legal process with specific responsibility for the programs responsible for providing legal services to boards and commissions and programs administered by the Secretary of DOH.
- Coordinate imminent danger and high priority cases for regulated health care professions and facilities.
- Identify solutions to address backlog and workload issues.
- Provide assistance and guidance relating to policy issues, rulemaking activities, and legislative matters related to regulatory or disciplinary topics.
- Serve as primary contact and the OILS resource for boards and commissions that regulate health care providers and/or facilities and for other HSQA programs.
This position is included in the Washington Management Service.
The duty station for this hybrid position is in Tumwater, WA. The incumbent will work with their supervisor to establish a work schedule to include telework and reporting to the Tumwater duty station for work activities at least twice per week.
The DESIRED Candidate Profile
NOTE: All relevant experience including paid and unpaid will be considered.
- Three (3) three years of experience as a hearing examiner, staff attorney, or assistant attorney general with demonstrated knowledge of administrative law principles and legal procedures associated with discipline of health care professionals.
- Technical expertise in the area of health professions discipline, including familiarity with state laws, including the Uniform Disciplinary Act and Administrative Procedure Act, as well as:
- Administrative legal processes;
- Administrative, constitutional, tort, and health law;
- The rules of evidence and trial procedures;
- Federal and state statutes, rules, and judicial decisions applicable to areas regulated by the Department;
- Departmental policies and organization;
- Statutes and rules regarding confidentiality of health care information and public disclosure of governmental information;
- Decision-writing standards and citation rules applied by courts of record, as well as the Department of Health Adjudicative Service Unit.
- Licensure as an attorney in Washington State.
