The Paralegal works under minimal supervision and is charged with the submission, processing, and compliance with legal requests received from local and state law enforcement agencies, regulatory agencies, outside attorneys, and courts. This includes management of and primary responsibility for the subpoena process at Denver Health, to include analyzing documents received, making independent sound decisions regarding the handling of and response to such documents, ensuring HIPAA compliance, and training staff on judicial processes and preparing/delivering testimony.The paralegal is responsible for developing protocols and resources for staff involved in legal matters, as well as guiding staff through the legal process and preparing them for legal proceedings. It is expected the paralegal will build strong relationships with outside governmental agencies and internal stakeholders and will develop an efficient and effective process for responding to legal requests while minimizing the risks to the organization and staff. In addition, the paralegal is responsible for managing certain organizational licensing requirements, overseeing litigation claim set-up including electronic file management, facilitating witness preparation, assimilating records, and working with our retained legal partners/firms.
Essential Functions:
Subpoena Management and ProcessingAnalyze and maintain subpoenas including but not limited to managing the service process, identifying witnesses, facilitating compensation and responding requests for hospital records . Prepare responses to regulatory agency subpoenas, including collecting and analyzing document. (30%)
Provider LiaisonLiaises with providers and attorneys regarding legal matters at Denver Health. Facilitate compensation in legal matters for the benefit of provider education. Educate medical staff on the judicial process and providing/delivering testimony, including HIPAA compliance. (20%)
External LiaisonServe as the organization's principal liaison to Denver (and the surrounding metro area) governmental entities with respect to Denver Health's processing and compliance of legal requests received from these entities. Negotiates with the Denver District Attorney's Office (DA), Denver City Attorney's office, Public Defender's Office, and all other Governmental Entities to establish, including through an MOU, an efficient process and understanding among institutions. (10%)
License Application, Submission and RenewalSubmit applications for and secure license renewals with the State of Colorado hospitals and clinics and other applicable agencies through the collection and analysis of relevant data, collaboration with internal stakeholders (Directors of Service and other hospital leadership). Submit license applications for expanded bed capacity. (10%)
Litigation and Settlement AgreementsOversee the litigation and claim process by drafting confidential internal documents, creating claim files, and preserving closed litigation claim files Manage litigation claim arrangement/structure. Draft settlement agreements and other litigation-related communications. Review and respond to malpractice insurance verification/claims history requests, analyze inquiries, research provider status and litigation claims (10%)
ComplianceEnsure CMS 111 compliance by acting as Account Manager for Denver Health, satisfying reporting requirements to Medicare, Medicaid, and SCHIP through Section 111 Portal on all judgments. (5%)
Policy and Practicereword Monitor legislation and industry standards for new compliance issues and analyze impact to select Risk Management Policies. Work with team to make policy updates, as needed. (5%)
Data Analysis and ReportingPrepare and maintain charts and data compilations which reflect the volume of work done and matters handled. (5%)
Fiscal and Resource ManagementManage daily budget operations. Prepare request(s) for payment of department invoices in a timely manner. Maintain budget spreadsheet with expenditures and reconcile spreadsheet for quarterly and annual budget report. (5%)
Education:
Post High School Diploma or Certificate Program Graduation from an accredited paralegal program approved by the Colorado State Board of Community Colleges and Occupational Education, or by an equivalent state regulatory organization. Required
Work Experience:
4-6 years Five years of legal experience Required
1-3 years Two years of experience in health care setting Required
1-3 years Three years of experience with legal document interpretation Required
1-3 years Demonstrated collaborations with Judicial and Regulatory Agencies.
Licenses:
Knowledge, Skills and Abilities:
Ability to analyze legal documentation, accounting for HIPAA and legal compliance across broad jurisdictions.
Skilled in legal research with the ability to interpret state and federal statutes and various legal documents on behalf of the organization. Has an understanding of the legal litigation landscape and the ability to respond professionally and appropriately while minimizing risk to the organization.
Possess critical thinking skills and sound exercise of independent judgment.
Professionalism when interacting with governmental and regulatory agencies, outside law firms, and DHHA staff.
Strong ability to support providers involved in various legal matters through experience and the developed protocol and resources.
Must be detail oriented, organized, able to manage a high-volume caseload, be able to handle difficult situations with kindness and professionalism.
