About the Role
TWE seeks an attorney with 8+ years of experience in intellectual property, commercial contracts, and privacy law. This role will provide practical legal advice on areas, including counseling on intellectual property and trade practice matters, marketing and advertising-related contracts, trademark clearance and enforcement, privacy and cybersecurity, including CCPA/CPRA compliance, and litigation and transaction support. Although the role is focused on the Americas region (U.S., Canada and LATAM), there are opportunities to participate in global IP and privacy projects. Knowledge of alcoholic beverage regulations and/or wine industry experience is a plus.
Key Responsibilities:
Provide fast and effective legal counseling on issues concerning intellectual property, marketing approvals, digital marketing content, social media, privacy, and compliance with relevant laws and regulations.
Advise the marketing and direct-to-consumer teams on trade practice issues, such as marketing events, consumer tastings, promotions, celebrity brands, sponsorships, contests, sweepstakes, and consumer advertising novelties.
Draft and revise marketing/advertising/innovation-related contracts, including agency and talent agreements, licenses, assignments, coexistence agreements, sponsorships, and influencer and endorsement agreements.
Oversee Americas’ IP portfolio including conducting and analyzing IP clearance searches and watches, instructing IP paralegals on applications, renewals and oppositions; drafting cease-and-desist letters, and supervising outside counsel.
Oversee Americas’ privacy and cybersecurity matters, including CCPA/CPRA compliance and participate in global privacy and cybersecurity initiatives as needed.
Participate in M&A matters, with a particular focus on IP and privacy diligence.
Participate in litigation matters.
Create an awareness and understanding of TWE’s IP, privacy and trade practice policies and procedures through regular training programs and stakeholder engagements.

About You
You have a Juris Doctor (JD) degree from a top-ranked law school.
You are an active member in good standing of the California Bar or eligible to be registered as an in-house counsel in California.
You have 8+ years of experience as a licensed attorney at a top-tier law firm or equivalent in-house experience, with a focus on intellectual property, commercial contracts, and privacy.
You have experience advising on infringement risks, risk mitigation, and managing related disputes.
You have strong Contract negotiation and drafting experience.
Familiarity with U.S. privacy laws and U.S. federal and state wine laws and regulations a plus.
You are self-motivated; a person who can work in a fast-paced international public company.
You have an entrepreneurial mindset that enables you to successfully work independently with little guidance, but also to use good judgment and escalate issues when needed.
You have Sound and practical business judgment.
You have excellent interpersonal and communication skills, including ability to distil complex legal concepts into actional advice for business partners.
You have excellent organizational skills and ability to multi-task with a strong attention to detail.
